Trademark Policy

Namezero.com, Inc. is an ICANN-accredited registrar and a leading provider of domain name-related services for small businesses and individuals seeking to establish a permanent identity on the web. We offer our members both free and fee-based services. Please click here for a description of these services. When a member opts to receive our free service, we register the domain name requested by our member and provide the member with tools, including e-mail forwarding and URL forwarding, that allow the member to use the domain name. Although we give our members control over the domain name, each domain name registered as part of our free service lists Namezero as the owner of the name in the WHOIS records. This arrangement gives Namezero needed flexibility in disputes over the registered name and/or the content of a member’s Web site.

When a member registers for a domain name using our service, we have no ability to screen registration requests for the millions of registered trademarks that exist today. If a name is available in the general pool of unregistered domain names, it can be registered by one of our members. Accordingly, without our knowledge, a domain name registered through our service may be identical or similar to the registered trademark of a third party.

We pride ourselves on having a good working relationship with trademark holders and their counsel when disputes arise in connection with a domain name registered through our service. We strive to avoid unnecessary litigation and arbitration costs, and are willing to work with all interested parties to reach an amicable solution to any dispute.

Your correspondence should include the phrase “Trademark Dispute” in the header, the name of the allegedly infringing domain name, the name of your registered trademark and any other information you feel is relevant to our investigation of this matter.

Under normal circumstances, we are able to resolve disputes within 7 to 10 business days of receiving a complaint. Our investigation of each complaint typically involves reviewing the member’s website and registration data to determine whether our Terms of Service have been violated and contacting the member to determine what preexisting rights, if any, the member has in the disputed domain name. If we agree that the domain name violates your intellectual property rights, we will remove the name from our DNS servers, meaning that a “server not found” error message will appear whenever any person attempts to access the domain name on the Internet.

We also pledge that the domain name will not be used for any purpose through the expiration date of the registration period, which is typically one or two years from the date the domain name was registered. After the registration period expires, the domain name will again become available for
registration.

Occasionally, trademark holders request that we transfer ownership of the domain name to them upon resolution of the dispute. If we determine that the domain name violates your intellectual property rights, we are not opposed to effecting a transfer of the domain name. However, we typically ask for a nominal transfer fee designed to cover the costs of the initial registration and the transfer (including fees paid to Network Solutions, Inc., notary public fees and personnel costs).

Former Members: Upgrade Seized Domains

For a limited time, former members of the Namezero Free Domain Services may elect to upgrade their expired or seized domain to the Namezero Plus Domain Services through the automated upgrade process available in the domain name's control panel. The expired or seized domain name's control panel is still accessible to the former member by simply logging-in to the "Member Sign-In" link in the Namezero header on the expired or seized domain or on the Namezero home page.

To log-in, use your Namezero domain name, without the "www" prefix, as your log-in name, and enter your password where indicated. If you have forgotten your password, you may click on the link indicated at "Forgot your password?" to have a password reminder sent to the e-mail address you specified during your domain name registration.

Once you have entered the control panel, you will see a button marked "Upgrade Service" in the header navigation area. Click on this link in order to start the upgrade sign-up process. The current upgrade price will be displayed during the upgrade process. Please note that this price will include a re-activation fee charged to violators of our Terms of Service.

If you decide not to upgrade your domain name, it may be sold to the highest acceptable bidder. Please note that successful bids are generally substantially higher than the price of an upgrade.
